Personal data is processed for the following purposes: responding to inquiries and providing requested services, executing contractual obligations and delivering technology services, sending service-related communications and updates, complying with legal and regulatory obligations under EU data protection law, and improving our website functionality and user experience.

1.4 Legal Basis for Processing

We process personal data based on: consent (Article 6(1)(a) GDPR), contractual necessity (Article 6(1)(b) GDPR), and legitimate interest in maintaining secure and efficient technology services (Article 6(1)(f) GDPR).

1.5 Data Retention

Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected. Client data is retained for the duration of the service agreement plus 5 years for accounting and legal compliance. Inquiry data is retained for 24 months from the date of last contact.

Section 02

Terms of Service

2.1 Acceptance of Terms

By accessing or using the services provided by VirellaVisualWorks, located at Rua Augusta 85, 1100-053 Lisboa, Portugal, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2.2 Scope of Services

VirellaVisualWorks provides enterprise technology services including network architecture, DevOps deployment pipelines, IT infrastructure management, cloud migration, cybersecurity, and related consulting services. All services are delivered according to the specific scope defined in individual service agreements.

2.3 Service Agreements

Each engagement is governed by a separate Service Agreement that defines scope, deliverables, timelines, and pricing. These Terms of Service apply universally to all service agreements unless explicitly overridden in writing.

2.4 Payment Terms

Payments are due according to the schedule specified in each Service Agreement. Invoices are payable within 15 days of issuance. Late payments incur a 2% monthly surcharge. VirellaVisualWorks reserves the right to suspend services for accounts overdue by more than 30 days.

2.5 Intellectual Property

Upon full payment, all deliverables and work products become the exclusive property of the client. VirellaVisualWorks retains the right to use general methodologies, frameworks, and non-proprietary knowledge gained during engagement for future projects.

2.6 Confidentiality

VirellaVisualWorks maintains strict confidentiality regarding all client data, systems, and business information. We comply with NDA obligations and implement industry-standard security measures to protect sensitive information throughout the service period and beyond.

2.7 Limitation of Liability

VirellaVisualWorks liability is limited to the total value of the specific Service Agreement giving rise to the claim. We are not liable for indirect, consequential, or incidental damages. This limitation does not apply to gross negligence or wilful misconduct.

2.8 Termination

Either party may terminate a Service Agreement with 30 days written notice. VirellaVisualWorks reserves the right to terminate immediately in cases of payment default exceeding 45 days or material breach of these terms.

2.9 Governing Law

These terms are governed by the laws of the Republic of Portugal. Any disputes shall be resolved in the courts of Lisboa, Portugal, unless otherwise agreed in writing.

Cookie Policy

Section 04

Refund Policy

4.1 Refund Eligibility

VirellaVisualWorks evaluates refund requests on a case-by-case basis, considering project milestones completed, deliverables produced, and the nature of the service agreement. Refunds are not guaranteed and are assessed according to the terms below.

4.2 Pre-Engagement Cancellation

If you cancel a service agreement before work has commenced, a full refund of any advance payments will be issued within 10 business days. Cancellation must be communicated in writing to [email protected].

4.3 In-Progress Services

For services already in progress, refunds are calculated based on the proportion of work completed. Milestone-based payments already earned are non-refundable. Any prepayments for unstarted milestones will be refunded minus a 10% administrative fee.

4.4 Completed Services

Services that have been fully delivered and accepted are non-refundable. Disputes regarding deliverable quality must be raised within 14 days of delivery, after which the deliverable is deemed accepted.

4.5 Monthly Retainers

Monthly retainer services (including proactive IT infrastructure management) require 30 days written notice for cancellation. The current billing period is non-refundable. No prorated refunds are issued for partial months.

4.6 Refund Process

Approved refunds are processed to the original payment method within 15 business days. VirellaVisualWorks will notify you via email once a refund has been initiated. Please allow additional time for your financial institution to process the credit.

4.7 Dispute Resolution

If you disagree with a refund decision, you may escalate the matter by contacting us at [email protected] with a detailed description of the issue. We commit to resolving disputes within 30 business days through good-faith negotiation before any legal proceedings.
